Employment discrimination is a practice by which an employer treats a certain employee differently. This does not mean that the employer favors this particular employee. It’s just the opposite. When an employer acts in unlawful way towards an employee, the act is considered as employment discrimination. This unjustified treatment is most based on age, sex, race, nationality, ethics and religion.
This act is illegal. Employment law strictly prohibits any employer to be unfair towards any employee due to the above mentioned factors. This is a punishable offense. However, the punishment depends on the state where the offense is being committed.
How will you determine that you are being a subject of discrimination act? In case, you notice that you are being replaced by someone younger, when you are still capable enough to perform your task, you are being a victim of employment discrimination. Or, if you notice that your employer is not promoting you and increasing your salary despite your best effort, this is another act of discrimination.
You should not endure this type behavior. You need to fight back. And since this is a legal issue, you should consult an experienced New Jersey discrimination lawyer. He/she will try to protect your right as an employee. You should not try to handle this alone. Remember that to derive a positive outcome of the lawsuit, you need to establish that you are efficient enough to perform your task or you deserve that promotion and your employer is just being unjustified towards you. This is not an easy task. Proving this requires excellent communication skill and quick wits.
